Workers’ Comp has two parts:

Statutory Benefits (medical, lost wages, disability, death) – these are set by state law and don’t have dollar limits.

Employers’ Liability Coverage – this protects the business if an employee sues for a work-related injury or illness. This is where the three limits come in.


1️⃣ Bodily Injury by Accident – Per Accident

- The maximum the insurer will pay for all claims from a single accident, regardless of how many employees are injured.

Example: A machinery malfunction injures multiple workers at once.


2️⃣ Bodily Injury by Disease – Policy Limit

- The maximum the insurer will pay for all disease-related claims during the entire policy period.

Example: Several employees develop an occupational illness over time.


3️⃣ Bodily Injury by Disease – Per Employee

- The maximum the insurer will pay to any one employee for a disease claim.

Example: One worker develops long-term respiratory issues from exposure on the job.
